And, there’s really not a clear cut answer that you can give to that question at the outset of a case. It depends on a number of factors. You’ve got what are called general damages and special damages. The special damages are the figures that we can put a number on that’s going to be your lost wages or your lost earning capacity in the future and how much your medical bills are and what your future medical care may cost. Then you have general damages and while the law here in West Virginia doesn’t allow us to put a figure on it it’s a very important measure of the damages that you suffer because that’s the pain, suffering, mental anguish, what you’ve went through and what your family has went through and how this is affected you. So, you really can’t give a straight answer on that without knowing a number of facts because you can have an instance where you have a 20 year old worker and a 60 year old worker who were injured and a lot of people would say well we think the 20 year old worker will likely get more. It depends on the facts of your case though it’s how good is the liability in your case versus the factors that I talked about when we look at the special and general damages. You have to consider all those before you can truly gain a measure of what a case may be worth.
