If I am injured on the job, what types of claims or benefits am I eligible for?

There are multiple claims or benefits that you may be entitled to. In West Virginia just like every other state in the country we have a workers’ compensation system that’s a no fault system. If you’re injured on the job, so long as you’re not intoxicated or it’s not a self-inflicted injury, you’re entitled to workers’ compensation even if you’re at fault or negligence negligent somehow in causing your injury to come about. What makes West Virginia unique is we are one of the few states that allows an employee under certain circumstances to bring a separate cause of action on top of a workers’ comp claim to get the recoveries that workers’ comp won’t provide you pain, suffering, the lost wages into the future, the difference in the income that workers’ comp would pay you versus what you were actually making when you were hurt. If an employer exposes you to a known unsafe condition that violates a federal safety rule, regulation or consensus safety standard in the industry and you were injured as a result of that you may have a claim for what’s called deliberate intent.
