Can a college student recover damages if they were injured or attacked on campus?
Transcript
It would, you’d have to look at issues such as had this occurred before in the same area. Is the area where it occurred properly maintained, is it properly lit. Basically, it comes down to what we call the law of forseeability and if there is reason that are reasonably prudent safe college administration, would have had precautions or taken measures in a certain area or certain individuals and yet failed to do that. And as a result there’s an attack, there could in fact be a claim against the college and university. These claims are very, very fact specific, they’re very complicated. If you or someone you know has been attacked on a college campus and you want to know what your rights might be or her rights might be or his rights might be then call us at Bailey Javins & Carter.
