If you or a loved one has sustained a workplace injury it’s important that you get a lawyer as soon as possible to protect your legal rights. An employer may not always report your injury to the proper authorities whether it be MSHA, The State Mine office, or OSHA, if you’re injured in a non-mining context. Here at Bailey Javins Carter, we know what the rules and regulations are that apply to reporting an injury and we’ll get requests out to these agencies to see whether or not your injury has actually been reported. Likewise, it’s important that you obtain a lawyer as soon as possible to place your employer on notice to preserve any evidence that may exist whether it be physical evidence or some documentary type of evidence pre-shift report, an equipment exam report because under the law an employer is only required for a certain period of time to keep these documents and they can be lawfully destroyed if you don’t place them on notice of a potential investigation of your claim.
