What should I do if I’m in an accident with a commercial truck?

The first thing you need to do and it’s very important if you can is to, first off is to give us a call here at Bailey Javins & Carter, myself or any attorney here, we’re well equipped to handle a commercial motor vehicle accident. There are laws that the Federal Motor Carrier Safety Administration puts out that truck drivers, commercial drivers are required to comply with. And, so it’s very very important for us to get on the case immediately in these cases because there’s blackbox data in the truck for example, technical data that the semi truck or the truck may have that can really, really tell us what happened that day. Because typically if you’re involved in an accident with a commercial truck, you’re very seriously injured, you’re probably immediately taken from the scene by ambulance or even helicopter to the nearest hospital to get treatment for your injuries. Commercial trucks are large they cause lots of damage. And, so it’s very very important that when you can is to give us a call so that we can come meet with you immediately and get on that case. The one thing in a commercial truck is also, you need if you’re involved in an action with a commercial truck, is you need to make sure that the PSC, the Public Service Commission, here in West Virginia does an inspection of that truck. They’re required to do a DOT Inspection, Department of Transportation inspection, of that truck. And, so that’s very important in addition to the police report that would be done because there’s several, several causes of the commercial trucking accident. There could be causes from driver fatigue all the way to a poorly maintained brakes. And, so it’s very, very important to give us a call immediately.
